The Board of Adjustments is a body whose existence and jurisdiction are established by the state zoning enabling act. Hence, the Board of Adjustments is an entity recognized by state law and not merely a creature of local ordinance.

The Board of Adjustments’ role in the zoning process is limited in comparison with the Plan Commission and City Council. The Board, unlike the Commission and Council, does not have the authority to change the zoning ordinance or the zoning on a particular piece of property. Instead, the Board of Adjustments is empowered to grant relief from certain provisions in the zoning ordinance where literal compliance would result in unnecessary hardship. The Board serves in what the law calls a “quasi-judicial” capacity, that is, the Board is somewhat like a panel of judges. The decision of the Board of Adjustments must be based solely upon the evidence presented to the Board at the hearing on a request before the Board. The decision of the Board is, thus, more of a judicial, as opposed to a legislative, function – assessing and weighing the facts of a particular case rather than determining generally applicable policy and making law.

BOARD MINUTES & AGENDAS

The Community Development Corporation (CDC) Board consists of 7 members appointed by the Town Council, with the Mayor serving as an Ex-Officio member. The CDC Board oversees community and economic development activities of the Town. The CDC Board is advisory in nature. Its recommendation for funding is acted upon by the Town Council.

The CDC funds are primarily used for brick-and-mortar projects in the community from park improvements to development projects. Less than 10% of the CDC funds are used for promotional purposes.

The Town collects 1.5% of sales taxes revenues in Laguna Vista. Of this percentage collected, half a cent goes to the Community Development Corporation.

The CDC Board meets THE FIRST Monday of the month at 6pm at Town Hall, located at 122 Fernandez Street.

As per Section 11.01(b) of the Home Rule Charter, the Town Council shall by ordinance, establish an independent board of ethics to investigate and issue advisory opinions regarding any possible violation of conflict of interest and any financial disclosure policies.

The Library Board is an advisory board appointed by the Town Council. Their responsibility is to advise the Library Staff on matters dealing with the Public Library, located at 1300 Palm Blvd.

The mission of the Library Board is to provide quality materials and services, which fulfill the education, information, culture, and recreational needs of the community, in an atmosphere that is welcoming, respectful and business-like.

ADVISORY BOARD: Minutes & Agendas

The Parks and Recreation Board, appointed by the Town Council, advises on recreational activities for the community. The Town currently maintains Roloff Park, Veterans Park, Trail Park, and the Sports Park.

Roloff Park

The improvements to Roloff Park are complete. The Town spent over $1 million, using the 2011 Certificates of Obligation funds, to make major improvements to this park. A cover basketball court was added along with new playground sets; two pavilions, jogging/walking trail, exercise stations, a resurfaced parking lot for City Hall; irrigation system; and new signage.

Residents wanting to use Roloff Park for birthday parties and/or family events can print a special use permit application and submit it to the Town of Laguna Vista for the City Manager's review and approval at cm@lvtexas.us

Veterans Park

The Veterans Park on FM 510 is now complete. It includes engraved brick pavers along with five American flags. The Town Council recently declared Veterans Park to be a non-public park, meaning that it can only be used for veteran-related activities such as Veterans Day and Memorial Day.

Nature Trail Park

A walking and jogging trail has been added to the Town-owned 15 acres, located on the west side of Palm Blvd. This is a project being funded with a $100,000 grant from Texas Parks and Wildlife that the CDC Board matched with $25,000. The total project amount is $125,000.

There are two entrances to this Trail Park, one on Palm Blvd and the other one on Palo Blanco. The Trail Park has three observation blinds along with three natural ponds. Please respect the quiet zones as you walk towards these observation blinds.

Appointed by the Town Council, the Planning and Zoning Commission makes recommendations on rezoning, conditional use permits and subdivision plat requests.

At the July 8, 2014 meeting, the Town adopted the new Zoning Ordinance No. 2014-17) and map. This new ordinance replaces the 1962 ordinance.
